1. Agreement

1.1 These Terms & Conditions (“Terms”) govern your access to and use of our website and any purchases made through our online store.
1.2 By browsing the website and/or placing an order, you agree to be bound by these Terms, our Privacy Policy, and our Returns & Refunds Policy (collectively, the “Store Policies”).
1.3 If you do not agree, do not use the website or place an order.

2. Important legal note (Consumer Protection)

2.1 Nothing in these Terms is intended to limit any consumer rights that cannot legally be limited under South African law (including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”)).
2.2 Where these Terms conflict with non-excludable legal rights, the relevant
legal rights will apply.

3. Eligibility and capacity

3.1 You must be at least 18 years old, or have permission and supervision from a parent/legal guardian, to place an order.
3.2 You warrant that you have legal capacity to enter into a binding agreement.

4. Product information and availability

4.1 We take reasonable care to display accurate product information, images, and pricing. However, product images are illustrative and actual colours/appearance may differ due to device and lighting differences.
4.2 All products are subject to availability. If an item becomes unavailable after you place an order, we may cancel the affected item(s) and refund you.
4.3 We may limit quantities per customer or per order where required for fairness, anti-fraud, or stock management.

5. Pricing, promotions, and errors

5.1 Prices are shown in ZAR unless stated otherwise and may be inclusive or exclusive of VAT depending on how your store is configured.
5.2 Promotions, discount codes, and limited offers may be withdrawn or changed at any time, subject to applicable law.
5.3 If an obvious pricing error occurs (e.g., a system or human error), we may cancel the order and refund you, even if payment has been made.

6. Orders and acceptance

6.1 Placing an item in your cart does not reserve it. Stock is only allocated once your order is confirmed.
6.2 Your order is an offer to purchase. We accept your order only when we confirm acceptance (typically via an order confirmation email and/or once payment is successfully authorised/received).
6.3 We may refuse or cancel orders for reasons including suspected fraud, incorrect information, stock issues, or payment problems.

7. Payments

7.1 Payments are processed via third-party payment providers (for example, Bob Pay and/or PayFast). Your payment may be subject to the payment provider’s terms and verification requirements.
7.2 We do not store your full card details on our servers (card processing is handled by the payment provider).
7.3 If a payment is reversed, charged back, or later found to be unauthorised or fraudulent, we may recover the relevant amounts from you and/or suspend further orders, subject to law and due process.
7.4 You agree not to file a chargeback as a substitute for following our support and returns process. If you have an issue, contact us first at [support email].

8. Shipping, delivery, and risk

8.1 Delivery timelines shown on the website are estimates and are not guaranteed. Delays may occur due to courier constraints, peak periods, weather, or force majeure events.
8.2 You are responsible for providing accurate delivery details. If an order is returned or delayed due to incorrect address details, inability to contact you, or failed delivery attempts, you may be liable for additional delivery costs.
8.3 Risk in goods passes to you on delivery to the address provided (or on collection where collection is offered), subject to proof of delivery and applicable law.

9. Returns and refunds

9.1 Our Returns & Refunds Policy forms part of these Terms and must be read together with them.
9.2 Change-of-mind returns: We may accept returns within 14 days of receipt for a refund provided items are unused and in original packaging, and subject to the conditions in the Returns & Refunds Policy.
9.3 Return shipping costs are the customer’s responsibility unless the return is due to our error or defective goods, subject to the CPA.
9.4 CPA/ECTA rights: Certain statutory cancellation/return rights apply to online purchases and defective goods, and these rights are not limited by our policy.

10. Exchanges

10.1 Where exchanges are offered, they are subject to stock availability. If the replacement item is unavailable, we will refund you in accordance with the Returns & Refunds Policy.

11. Pre-orders and backorders (if you enable them)

11.1 If a product is marked as “pre-order” or “backorder”, you acknowledge that dispatch will occur only once stock becomes available.
11.2 Estimated dates are provided in good faith and may change. If delays become unreasonable, you may request cancellation and refund in line with applicable law and our policies.

12. Warranties and defects

12.1 If goods are defective or unsafe, your remedies are governed by applicable law, including the CPA.
12.2 Normal wear and tear, accidental damage, misuse, or failure to follow care instructions may void certain remedies to the extent permitted by law.

13. Website use, prohibited conduct

13.1 You may not misuse the website, attempt unauthorised access, introduce malware, scrape content at scale, or interfere with the site’s operation.
13.2 We may restrict or terminate access where prohibited conduct is reasonably suspected.

14. Intellectual property

14.1 All content, trademarks, artwork, logos, product names, and brand assets displayed are owned by or licensed to The Valhalla and may not be used without written permission.
14.2 Purchasing a product does not grant you any IP rights in our branding or content.

15. Privacy and data protection

15.1 We process personal information in accordance with our Privacy Policy and applicable data protection laws (including POPIA where applicable).
15.2 You consent to receiving transactional communications relating to your order (order confirmations, shipping updates, support messages).

16. Limitation of liability (important)

16.1 We will not be liable for indirect or consequential losses (loss of profit, loss of data, reputational harm), except where liability cannot be excluded under law.
16.2 To the maximum extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for the specific product(s) giving rise to the claim.
16.3 Nothing in these Terms excludes liability for gross negligence, fraud, or any liability that cannot legally be excluded.

17. Force majeure

17.1 We are not responsible for failure or delay caused by events beyond reasonable control, including strikes, courier disruptions, power/network failures, extreme weather, or governmental actions.

18. Disputes and governing law

18.1 These Terms are governed by the laws of the Republic of South Africa.
18.2 Before initiating formal proceedings, you agree to contact us and allow a reasonable opportunity to resolve the issue.
18.3 Where you are a consumer, you may have rights to approach consumer protection bodies or ombuds structures as provided by law.

19. Changes to these Terms

19.1 We may update these Terms from time to time. The latest version will be published on the website with the effective date updated.
19.2 Changes will not affect orders already accepted, unless required by law or to address fraud/security issues.
